Terms of service
1. Acceptance
By using aiposture.org, including the pre-assessment at aiposture.org/assess/, you agree to these terms. If you do not agree, do not use the site.
2. Who we are
The service is operated by PAICE.work PBC, a US public benefit corporation. The AI Posture framework and pre-assessment are stewarded by PAICE.work PBC under a planned transition to an independent steward (PAICE Foundation).
3. What the pre-assessment is
The pre-assessment is a Bayesian adaptive self-administered tool that produces an estimated AI Posture (formally Aggregated Intelligence Posture) for your organization based on your answers. The output is labeled an estimate, not a verified assertion.
4. What the pre-assessment is not
- Not a certification. No seal. No attestation of compliance.
- Not an audit. No independent verification. No evidence collection.
- Not legal advice. The Regulation vector discusses obligations. It does not tell you how to meet them for your jurisdiction. Consult qualified counsel for legal questions.
- Not a substitute for per-vector measurement. Verified assertions require the reference implementations named in the framework documentation.
- Not a scoring leaderboard. No public directory of scores is published. Only aggregate statistics, without attribution.
- Not a sales qualifier. Low estimates do not gate access to reference products. High estimates do not unlock anything.
5. Your answers, your rights
You retain all rights to the answers you provide. During the pre-assessment, your in-progress answers are stored only in your browser's sessionStorage. If you request email delivery of your JSON estimate artifact, the artifact is transmitted to us for delivery and stored under a random run ID as described in the privacy policy.
By requesting artifact delivery, you grant PAICE.work PBC a non-exclusive license to use the submitted artifact in aggregate, non-identifying form to publish ecosystem statistics and to recalibrate the pre-assessment's likelihood tables. This license does not extend to identified use or third-party disclosure of your individual run.
6. Licensing of framework materials
The AI Posture specification (SPEC.md), the pre-assessment question bank, likelihood tables, and rubric content are released under the Creative Commons Attribution 4.0 International License (CC BY 4.0). You may reimplement, translate, adapt, and redistribute them under the terms of that license.
Reference implementations (the code powering this site) are released under the MIT license.
7. Acceptable use
You agree not to:
- Use the pre-assessment to make, publish, or imply a verified compliance or certification claim.
- Misrepresent the result as anything other than an estimate.
- Access the service in a manner intended to disrupt, degrade, or overwhelm it.
- Reverse-engineer the service to extract personal data about other users. The service is designed so that no such data exists, but the prohibition stands regardless.
- Use the service in any way that violates applicable law.
8. No warranties
The service is provided "as is" and "as available." To the maximum extent permitted by law, PAICE.work PBC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability. The estimate produced by the pre-assessment is not guaranteed to be correct. Likelihood tables are expert-elicited and subject to recalibration.
9. Limitation of liability
To the maximum extent permitted by law, in no event shall PAICE.work PBC, its officers, directors, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service, whether based on contract, tort, strict liability, or any other legal theory. The total aggregate liability for any claim arising out of or related to the service is limited to USD 100.
10. Indemnification
You agree to indemnify and hold harmless PAICE.work PBC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service in violation of these terms or applicable law, or from any representation you make about the estimate that exceeds what the estimate actually supports.
11. Third-party links and processors
The site links to third-party resources, including reference products (PAICE.work, Siteline, EveryAILaw), the PAICE newsletter hosted on Substack, and others. We do not control third parties and are not responsible for their content, terms, or practices.
We use Cloudflare (Workers and D1) to host the API and database, and Resend to deliver newsletter and artifact emails. These are processors acting under our instructions. See the privacy policy for details on what each handles.
12. AI Posture newsletter
If you subscribe to the AI Posture newsletter, you agree to receive occasional updates about the spec and pre-assessment at the email address you provided. Subscription is double opt-in: it is not active until you click the confirmation link. You may unsubscribe at any time as described in the privacy policy. The AI Posture newsletter is separate from the PAICE newsletter on Substack.
13. Changes to the service
The pre-assessment is provided on an as-is, evolving basis. We may add, remove, or change features without notice. The question bank and likelihood tables are versioned. Completed runs are tagged with the version under which they ran, so recalibration does not retroactively change prior results.
14. Changes to these terms
Material changes trigger a new effective date at the top of this page. Continued use after the effective date constitutes acceptance of the updated terms. The repository commit history is authoritative.
15. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of or related to these terms will be resolved in the state or federal courts sitting in Delaware, and you consent to personal jurisdiction there. If you are a consumer located in a jurisdiction whose law grants you mandatory rights that cannot be waived, those rights are preserved.
16. Severability
If any provision of these terms is held unenforceable, the remaining provisions remain in effect.
