Beta notice. These terms are a working draft under legal review. The pre-assessment and framework are provided as a beta. Terms may change before general availability. Material changes update the effective date above and are visible in the repository commit history.

1. Acceptance

By using aiposture.org, including the pre-assessment at aiposture.org/assess/, you agree to these terms. If you do not agree, do not use the site.

2. Who we are

The service is operated by PAICE.work PBC, a US public benefit corporation. The AI Posture framework and pre-assessment are stewarded by PAICE.work PBC under a planned transition to an independent steward (PAICE Foundation).

3. What the pre-assessment is

The pre-assessment is a Bayesian adaptive self-administered tool that produces an estimated AI Posture (formally Aggregated Intelligence Posture) for your organization based on your answers. The output is labeled an estimate, not a verified assertion.

5. Your answers, your rights

You retain all rights to the answers you provide. During the pre-assessment, your answers are stored only in your browser's sessionStorage and are not transmitted to us. If per-run storage is enabled in a future release, the privacy policy will govern retention and deletion.

By submitting answers for storage (when that feature is live), you grant PAICE.work PBC a non-exclusive license to use the answers in aggregate, non-identifying form to publish ecosystem statistics and to recalibrate the pre-assessment's likelihood tables. This license does not extend to identified use or third-party disclosure of your individual run.

6. Licensing of framework materials

The AI Posture specification (SPEC.md), the pre-assessment question bank, likelihood tables, and rubric content are released under the Creative Commons Attribution 4.0 International License (CC BY 4.0). You may reimplement, translate, adapt, and redistribute them under the terms of that license.

Reference implementations (the code powering this site) are released under the MIT license.

The service is provided "as is" and "as available." To the maximum extent permitted by law, PAICE.work PBC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability. The estimate produced by the pre-assessment is not guaranteed to be correct. Likelihood tables are expert-elicited and subject to recalibration.

9. Limitation of liability

To the maximum extent permitted by law, in no event shall PAICE.work PBC, its officers, directors, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service, whether based on contract, tort, strict liability, or any other legal theory. The total aggregate liability for any claim arising out of or related to the service is limited to USD 100.

10. Indemnification

You agree to indemnify and hold harmless PAICE.work PBC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service in violation of these terms or applicable law, or from any representation you make about the estimate that exceeds what the estimate actually supports.

The site links to third-party resources, including reference products (PAICE.work, Siteline, EveryAILaw), the PAICE newsletter hosted on Substack, and others. We do not control third parties and are not responsible for their content, terms, or practices.

12. Changes to the service

The pre-assessment is a beta offering. We may add, remove, or change features without notice. The question bank and likelihood tables are versioned. Completed runs are tagged with the version under which they ran, so recalibration does not retroactively change prior results.

13. Changes to these terms

Material changes trigger a new effective date at the top of this page. Continued use after the effective date constitutes acceptance of the updated terms. The repository commit history is authoritative.

14. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of or related to these terms will be resolved in the state or federal courts sitting in Delaware, and you consent to personal jurisdiction there. If you are a consumer located in a jurisdiction whose law grants you mandatory rights that cannot be waived, those rights are preserved.

Jurisdiction note. Because the pre-assessment does not collect personal data during the flow and relies on opt-in email only at the end, most consumer-law concerns do not attach. Where they do, the strictest applicable jurisdiction governs.

15. Severability

If any provision of these terms is held unenforceable, the remaining provisions remain in effect.
